Has the ‘Yes Movement’ been derailed?

Scotland-Magnified-webI used to do a few blogs a day, now I am doing a few a week. The same old imaged and questions, valid for sure, but repetitive for many. Spoke to a few on Skype and other ways and it seems many feel the same as myself. The Yes movement has become an angry one, I am not saying everyone is angry but what we are writing is being distorted by ‘whoever’ for ‘whatever’ reasons. I seen it many months ago, I called them shills and I thought if we didn’t out them as 1 unit of people we would fall as individuals. Well sadly this is the way I see it happening these days. I still want a free Scotland and will do all I can, like you, like many people by sharing the truth be that truth huge or so small we can’t see it till someone points to it. The movement is divided to the point yes voters now argue.

Until there is purpose and reason for me to write and research again I bow out for now. Really is just the same talk, images and stories, it’s getting boring and the yes movement is not what it was before the 2014 referendum. I have said it for so long now that I am actually being swayed by the very actions of the people I am trying to point to and say “They are liars and no voters”

No way will I give in on a free Scotland but when people ask me “Why do you always work on your own” when people ask if I will become part of their movement my response is always the same “Who do we trust” I know who I can trust but the people I know I can trust, are they trusting the correct people? No hate, just observations of boredom from me, no biggy people. Keep on keeping on and maybe one day we will be free. Because right now we are talking and saying nothing, walking and going nowhere.

No Voters and Yes voters. With no hate, why did you vote no or yes?

I will keep this short, I will PLEASE ask for no hatred. I had reasons for voting yes, they were good solid reasons. We can fiscally go it alone, we can be a Scotland alone and in the EU. We have the resources to go it alone. Whiskey and Tourism generate more fiscal abilities for Holyrood. I wanted an end to poverty. Look to North Europe, Denmark, Sweden, Finland, Holland and Iceland who jailed the bankers while we bailed them out without being asked and people were still thrown out of their homes AFTER we bailed them out. I voted yes for my kids, I don’t want my kids to be living in a Country ruled by a Party we did not vote for, also I don’t want Nuclear weapons in my Country, Thatcher put a lot of things up here away from the safety below the Watford gap, but for the old, the poor and disabled, I seen the human cost No voters just won’t look at, many want to hate. So no voters, please, and yes voters also, keep this real.

Alistair Carmichael will face questions over why he denied his involvement in leaking a memo intended to damage Nicola Sturgeon. 

The Liberal Democrat MP Alistair Carmichael faces the prospect of giving evidence in court about why he lied about his involvement in leaking a memo intended to damage Nicola Sturgeon after a crowdfunded legal challenge to the Orkney and Shetland MP’s re-election in May passed its first hurdle. Judges in the election court, which is sitting for only the third time in 50 years, ruled on Tuesday that the petitioners passed the first test of whether Carmichael’s lie amounted to illegal practice under the Representation of the People Act 1983. A group of constituents raised £88,000 through crowdfunding to challenge Carmichael’s re-election because voters were unaware of his involvement in leaking the memo at the time of the election, due to his initial denial. The day after the leak, Carmichael told Channel 4 News that the first he became aware of what had happened was when a journalist informed him of it.

He subsequently admitted, following a Cabinet Office inquiry that concluded in May after the election, that he had authorised his special adviser to release the memo about a private conversation in which Scotland’s first minister purportedly told a French diplomat she wanted David Cameron to remain the UK prime minister. Sturgeon and the diplomat have both made clear that the memo was inaccurate. Lady Paton and Lord Matthews ruled that “a false statement by a candidate about his own personal character or conduct made before or during an election for the purpose of affecting his return at the election has the effect of engaging section 106” of the Representation of the People Act 1983.

The judges then stated that they wish to hear evidence in relation to two remaining issues – the distinction between a personal and political lie for the purposes of the act, and whether that lie affected the ultimate outcome of Carmichael’s election – before giving a determination and report to the House of Commons.

The constituents who brought the case welcomed the ruling, saying: “We are delighted that the courts have vindicated our position so far, that the legislation is relevant and there is a case for Mr Carmichael to answer. We look forward to the proof hearing, where questions of his intention and character are considered.” “All the way through this process, we have been very clear that the best outcome is for Mr Carmichael to stand down swiftly so that we can have a byelection as soon as possible.” Cary Welling, another of the petitioners, said the fact that the judges had not immediately thrown out the case, despite the unusual nature of the case and the arcane case law involved, proved that the judges were “going with the spirit of the times”. Welling added: “There is a trend towards accountability and electors holding their politicians to account.”

The election court, which met over two days at the beginning of September, heard highly technical and at times florid legal argument, which included references to Katharine O’Shea and George Washington’s cherry tree. One of the key points of discussion, and arguably of most concern to ordinary electors, centred on the distinction between lies that are political rather than personal in character.

For the petitioners, Jonathan Mitchell QC explained that, according to the act and subsequent case law, there is a broad distinction between political statements that parliament “trusted the good sense of the electorate” to be able to discount, and those relating to a candidate’s personal character or conduct, the truth or otherwise of which the electorate might be “unable to discern” in the middle of an election campaign.

Carmichael’s counsel, Roddy Dunlop QC, argued that his denial was political “from the beginning to the end” while Mitchell contended the opposite, arguing that the fact there is a political background does not disqualify something from being personal. Mitchell told the court: “He puts on to the scales his reputation of personal trustworthiness, and that is purely personal because whether or not the leak is political, nothing in politics called upon him to lie about this.”

Now Carmichael faces the prospect of justifying this lie himself in open court. It is likely that the subsequent hearing will be televised, as the earlier sessions were. While there has been some suggestion that the hearing could move north to the constituency in question, the logistics involved in travel to Orkney and Shetland mean that subsequent sessions are expected to be heard in Edinburgh and live-streamed to Kirkwall and Lerwick.

When I wrote this 12 days ago Scotland – Jeremy Corbyn, Royal Family, Trident, House of Lords, Israel & Video’s <Click) I got a bit of abuse to be fair, not complaining, having an opinion and sharing it will get you all kinds of reactions and opinions so I am used to it. But I will say again I think Jeremy will help more than hinder the Scottish Yes Movement. This is one thing we were told he would backtrack on, but no! He is siding with the SNP/Wales/Greens, this could be HUGE for Trident’s future, how long till Mr Corbyn is called a little Hitler like Nicola Sturgeon was? Jeremy Corbyn has confirmed he will work with the SNP to try and scrap Britain’s nuclear deterrent despite opposition to the move from his own backbenches. The Labour leader reaffirmed his long-standing opposition to Trident and said he would vote with the 56 Nationalists at Westminster on the issue. Mr Corbyn said he would like to see thousands of jobs associated with nuclear defence in Scotland transferred to other forms of high-value engineering, but did not specify what these were.

The SNP welcomed his comments but said the “real test” would be whether he can persuade his party when its debates calls for Trident to be scrapped at its conference, which starts this weekend.

The Tory majority in the Commons, combined with the support of pronuclear Labour MPs, means the Government is highly unlikely to lose a vote on the deterrent’s renewal.

Although a vote in the Commons is not scheduled to take place until next year, earlier this month George Osborne announced £500 million to revamp its home at the Faslane naval base on the Clyde and make it fit for purpose until at least 2067.

I KNEW IT AND SAID IT! Scottish Independence could renew Labour When Johann Lamont stood down I suggested perhaps she was deep down a yes voter. I also said I believed at the time through speaking to people and research there was a HUGE  yes vote within the Scottish Labour Party, now here is the proof. Inside Labour Scotland there is a HUGE Yes movement and I would say over 50%. Their Leader and Vice Leader stood down soon after the No vote last September and I said in a few blogs it was my belief there was a good amount of Labour MP’s being slapped down.

August 17th I suggested Scottish Independence could renew Labour Maybe I was seeing internal Labour killing each other, maybe I should have blogged it more, I am now looking back a year blogging to see if I can find some more evidence or articles then that become more today, things we just didn’t look at and now we do, like many things I am sharing here. What if all along Labour Scotland actually wanted to say “Stuff you London, we are not doing this” Because when Johann Lamont said “Labour London treat Scottish Labour like a branch office” These words by Johann today are more than they were at the time. Now we see Johann was in-fact a yes voter but having to do what she was being paid to do, same “Paid to do” as the BBC allegedly had to do. We remember also Kevin Bridges saying “Everyone in this BBC building wants to vote yes, we have been told not to mention it” Remember? Kevin Bridges admits to BBC lies, 100% Looking back the words were huge, today they are more, especially with Alex Salmond coming out AT LAST on the record saying “The BBC were bias” Kevin Bridges said it, as did many looking back. Now the story is MORE!

Labour should consider having a free vote in any future independence referendum, according the party’s former Scottish leader Johann Lamont.Ms Lamont was speaking as part of a series of BBC Scotland interviews to mark the anniversary of the referendum.The Labour MSP said it was “self-evident” that some people within the Labour movement had accepted that Scotland could be independent. She said a free vote was a debate the party should have.

In the previous interview in the series, Blair Jenkins, the former chief executive of the Yes campaign, appealed to the new Scottish Labour leader Kezia Dugdale to allow members to be allowed to campaign for independence.

He told last week’s Good Morning Scotland programme he thought there would be “very strong pressure” on the party to do that – even if the official position would be against independence.

Mr Jenkins said he would prefer Labour to back a Yes vote but “as a minimum position” they should allow prominent people in the party to campaign against its policy as they did in the 1979 devolution referendum.

She told Good Morning Scotland: “We know that there were Labour people who supported Yes and we need to understand what that was and have that debate inside the party.
“It’ll be for others to decide whether you then make it a free vote. People clearly exercised their vote in the ballot box anyway.”
She added: “If that’s a debate we should have inside the party, why not? Because what is self-evident is that there were people within the Labour movement more broadly who did accept the argument that Scotland could be an independent country.”

Despite saying the idea of a free vote should be debated, Ms Lamont added any decision over independence was “far bigger” than what was voted on in 1979. Ms Lamont also said that “on balance” she believed Labour was right to join with the Conservatives in the Better Together campaign.
But she said Labour should have had a better resourced and more energetic campaign of its own. In the interview she said she felt “pushed to jump” before she left the role but she refused to point the finger of blame at Ed Miliband or at Margaret Curran, an old friend who was at the time shadow secretary of state for Scotland.

Due to this process and her own words from that very night in the video below after reading the October 11th blog will leave a sour taste in the Yes Movements mouth. I also wrote this blog Ruth Davidson, Tory – Admits Vote Fraud LIVE ON TV! and not too many people kept on this story, to be fair I almost forgot till the news broke on Wednesday that information on Ruth Davidson has been handed to the Crown Office to debate if there are any charges to be pressed against the Scottish Tory leader. They spoke to her a year ago, now they hand the conclusion of their 1 year police research on this matter to the Crown to decide. This could be UTTERLY HUGE!! Like many do I kept a recording and uploaded it as I do with all news from the Scottish freedom movement coming from either side, I keep it all on a spare drive because we never know what small detail we might see as huge news in the future, if this goes the way I expect, using a bit of education and logic, this could see a Politician in the dock on alleged irregularities on the lead-up to the September 14th Scottish Referendum. This video I saved is what may see her get her day in court that COULD open up the entire cheating allegations story that followed in the months after the no vote. I said I was going to forget this alleged ‘Scotland were robbed’ story as it’s more important we go forwards, this news will bring everyone back to the story. POLICE Scotland have passed on “information” to the Crown Office having concluded a year-long investigation into allegations pro-Union campaigners breached electoral secrecy laws during the Scottish independence referendum.

The development comes nearly a year after police were instructed to launch an official probe over complaints surrounding comments made by Scottish Conservative leader Ruth Davidson that postal vote “tallies” were being taken in the weeks before the referendum ballot closed at 10pm on September 18.

On televised coverage of the referendum results, 45 minutes after the polls closed, Ms Davidson said that the Better Together camp had been “incredibly encouraged” by the results of a “sample opening” of the postal ballot that she said had taken place around the country over the few weeks prior to the poll. Complaints over her account of the postal vote “tallies” raised concerns the information may have helped inform the No campaign’s decision to issue the “vow” of more powers for Scotland from the three main party leaders.

Police Scotland has confirmed that they have now completed their investigation which was launched after the Crown Office instructed that there should be a formal probe following the complaints. The Herald revealed that police twice spoke to Scottish Conservative leader Ruth Davidson as a potential witness over comments she made that the “tallies” were being taken in the weeks before the referendum ballot closed at 10pm on September 18 last year.

It is understood no arrests have yet been made and there are no outstanding warrants. A Police Scotland spokesman said: “Police Scotland has completed enquiries and the matter now rests with the Crown Office and Procurator Fiscal Service.” A Crown Office spokesman added: “The Crown Office has received information regarding the investigation carried out by Police Scotland and will consider if further action is necessary.”

Political agents and campaigners are allowed to oversee the postal vote opening sessions, where checks are made to verify the signatures and dates of birth on postal voting statements against computerised records.

However, Elections Scotland instructions on postal votes in advance of the referendum stated that it is “an offence for anyone attending the opening of postal votes to attempt to ascertain how any vote has been cast or to communicate any such information obtained”.

Failure to observe the secrecy requirement is a criminal offence punishable by up to 12 months in prison and/or to a fine of up to £5,000. Guidance provided to electoral administrators and returning officers for the General Election, as a result of the experience of the referendum, were warned to keep the postal ballot secret and told that voting tallies by political agents is illegal.

Mary Pitcaithly, convener of the Electoral Management Board for Scotland recommended to returning officers in Scotland that they take particular care in making sure the law was complied with during the General Election and that the secrecy requirement was explained to all those attending postal vote openings.

The moves which the EMB said “draw on lessons learned from the Scottish independence referendum” include asking that ballot papers are handled face down so that no mark on the front of the paper is able to be seen by observers. The postal vote, made up between 20% and 50% of the counted votes. Around 800,000 people, or 19% of participants, voted by post in the referendum.

The Electoral Commission has also advised all electoral administrators that the law prohibits tallying at postal vote opening sessions.

The advice states that under the Section 66(4)(d) of the Representation of the People Act 1983 it is “not permissible to attempt to ascertain the candidate for whom any vote is given in any particular ballot paper or communicate that information.

“This provision therefore prevents those present at the postal vote opening from attempting to ascertain the way individual ballot papers are marked.” Police have refused over the year of the investigation to comment on what progress they have made Some complainers raised concern that no police action had been taken in advance of the General Election. Video footage of Ms Davidson talking about the ballot viewing was forwarded to both the police and the Electoral Commission.

In televised coverage she says: “Postal votes are going to be enormously important in this campaign; about 18 per cent of the vote is going to come out of postal ballots and we have had people at every sample opening, around the country, over the last few weeks, while that’s been coming in. And we’ve been incredibly encouraged by the results.”

Later, referring to postal ballots, she said: “Different local authorities have had openings around the country”, adding, “there’s people in the room that have been sampling those ballot boxes that have been opened and have been taking tallies and the reports have been very positive for us”.

Labour call for all Scottish VAT revenue to stay in Scotland

I wrote this here a few days ago, got abuse from 5% Scotland – Jeremy Corbyn, Royal Family, Trident, House of Lords, Israel & Video’s I wasn’t saying he would win the next General Election then free Scotland but the point I am trying to make is I think he will demand what the No vote was promised in the ‘Edinburgh Agreement’. This guy isn’t an Eton boy or part of any establishment, in-fact he is the opposite. Opposed in some way to the House of Lords, Royal Family and Trident, a little research will show you this. Now here we have Labour demanding the same as the SNP in terms of I am guessing full fiscal home rule, or this is at least what it seems first read. The blog above was done quickly with not a lot of research, I researched a little more and we see Jeremy Corbyn is a Socialist, I think we can all agree ‘Interesting times ahead’ I will always vote SNP and I will always want full freedom, I am asking again if this man can help get us there quicker?

Labour is calling for all the cash raised from VAT in Scotland to be assigned to Holyrood, giving MSPs even greater financial power. Shadow Scottish secretary Ian Murray said the change would increase the Scottish Parliament’s spending power by £5 billion.

The Scotland Bill, which is currently going through Westminster, proposes assigning some of the money raised from VAT in Scotland to Holyrood. But Labour have put forward an amendment calling for all the money raised from the levy in Scotland to be assigned to the government there.

Mr Murray said: “Labour is the party of devolution. It was a Labour Government, after a decision by people across Scotland, that created the Scottish Parliament in 1999 and we will show that same ambition and determination in pushing for more powers in the Scotland Bill. “We are focused not just on making sure that the Scottish Parliament gets the powers it needs, but also on how we will use those powers to improve the lives of people across the country.”

As well as calling for all VAT revenues raised in Scotland to be assigned to Holyrood, Labour has put forward amendments that would allow the Scottish Parliament to top up welfare payments when when an individual has been sanctioned. The party is also calling for an investigation into concerns raised by charities across Scotland about the impact that Holyrood’s new income tax powers could have on the Gift Aid system.

Mr Murray said: “We have approached the Scotland Bill constructively, because this is a real opportunity for people across Scotland, and we want to make sure they get the powerhouse Parliament at Holyrood they were promised. “Our amendments would significantly increase the powers currently in the Scotland Bill by assigning £5 billion more of revenue and ensuring that the Scottish Parliament has the powers over welfare that Scotland needs to design its own social security system. “We are also pushing the Government to review the Gift Aid system in light of the new income tax powers. Many charities across Scotland have raised with me their concerns about the impact on gift aid. It’s essential that we get to the bottom of these issues before the new powers are implemented.”
Scottish Labour’s democracy spokeswoman, Claire Baker said: “The full powers of the Smith Commission will give Scotland one of the most powerful devolved Parliaments in the world, that’s why the Scottish Labour Party will ensure they are delivered in full. “These powers will give the Scottish Parliament significant control over the social security system in Scotland and the ability to create a new social security system for Scotland.

“It’s essential that when these powers are devolved, power isn’t hoarded in Holyrood. We have to empower local government and communities across Scotland by devolving more power to them as well. We need to give people powers to challenge a Scottish Government which has been one of the most centralising administrations Scotland has had.”
