I think as a Scottish person we see this letter by Nicola not from a Politician or Political view but a person like all us true Scottish People who have the exact same DNA meaning we ‘Just care’ The letter sent by Nicola to Deborah Chester, mother to disabled kid Stuart Chester had good news attached, the devolved powers coming to Scotland very soon will give the SNP complete control of the DWP or the Scottish version of it. When we were asked to vote Yes or No for a free Scotland I often wonder how many Scottish people forgot the real and human cost that a no vote brought. Sure 8 month’s later on May 7th this year we turned Scotland yellow, but these new powers need to be sent yesterday, the holding back by London is gathering every spare pound they can get from Scotland before we start owning all our Fiscal ways at Government and Scottish level. THE First Minister has written a letter to the family of a severely disabled man targeted by Iain Duncan Smith’s welfare cuts.

Nicola Sturgeon sent the letter to Stuart Chester’s mother Deborah saying she was saddened to read of her son’s treatment by the Department of Work and Pensions (DWP) in The National.

Mother-of-two Deborah, 51, told how her son, who has Down’s syndrome and autism had been ordered to prove he is unfit for work. Stuart cannot speak, read, wash or clothe himself. The 25-year-old, from Glasgow, who is cared for round-the-clock by his mother, was sent a 20-page work capability assessment form investigate his fitness for work and whether he is entitled to his Disability Living Allowance (DLA) and Employment and Support Allowance (ESA) benefits.

In her letter to Deborah, Sturgeon wrote:

“I was saddened to read of Stuart’s treatment by the DWP. Saddened, but I am sorry to say not surprised. The Scottish Government is concerned about many aspects of the UK Government’s welfare reforms, including the treatment of disabled people. We continue to press the UK Government to make improvements and to ensure safeguards are in place for those who need them. You may be aware that, as a result of the Smith Commission process, disability benefits will eventually be devolved to the Scottish Parliament. We will give careful consideration as to how best to ensure that our new powers are tailored to the needs of the people of Scotland and will ensure that individuals, communities and organisations have their say on this . We are very clear that principles of dignity and respect must be central to the development of disability benefit policies in Scotland.”

Deborah and her daughter Amanda said they have been overwhelmed by the support from the First Minister and secretary for social justice Alex Neil. They also wanted to thank Natalie McGarry MP, SNP spokesperson on disabilities, for offering to help.

Deborah said: “It was really nice of Nicola to send us that letter and it meant a lot. “The support we have had since we spoke to The National about Stuart’s case has been phenomenal from people all over the world. Having these high-profile politicians on our side has helped a lot and hopefully together we can prevent other vulnerable people being targeted.”

Around 2,380 people have died between December 2011 and February 2014 after being found fit for work and losing benefits, Department for Work and Pensions (DWP) figures show.

A DWP spokeswoman said:

“It’s impossible to make any link in these statistics between someone dying and their being found fit for work.” On Stuart’s case, the DWP added: “We regularly review people’s conditions to ensure that they are not simply written off and condemned to a life on benefits.“

I also wrote this blog Ruth Davidson, Tory – Admits Vote Fraud LIVE ON TV! and not too many people kept on this story, to be fair I almost forgot till the news broke on Wednesday that information on Ruth Davidson has been handed to the Crown Office to debate if there are any charges to be pressed against the Scottish Tory leader. They spoke to her a year ago, now they hand the conclusion of their 1 year police research on this matter to the Crown to decide. This could be UTTERLY HUGE!! Like many do I kept a recording and uploaded it as I do with all news from the Scottish freedom movement coming from either side, I keep it all on a spare drive because we never know what small detail we might see as huge news in the future, if this goes the way I expect, using a bit of education and logic, this could see a Politician in the dock on alleged irregularities on the lead-up to the September 14th Scottish Referendum. This video I saved is what may see her get her day in court that COULD open up the entire cheating allegations story that followed in the months after the no vote. I said I was going to forget this alleged ‘Scotland were robbed’ story as it’s more important we go forwards, this news will bring everyone back to the story. POLICE Scotland have passed on “information” to the Crown Office having concluded a year-long investigation into allegations pro-Union campaigners breached electoral secrecy laws during the Scottish independence referendum.

The development comes nearly a year after police were instructed to launch an official probe over complaints surrounding comments made by Scottish Conservative leader Ruth Davidson that postal vote “tallies” were being taken in the weeks before the referendum ballot closed at 10pm on September 18.

On televised coverage of the referendum results, 45 minutes after the polls closed, Ms Davidson said that the Better Together camp had been “incredibly encouraged” by the results of a “sample opening” of the postal ballot that she said had taken place around the country over the few weeks prior to the poll. Complaints over her account of the postal vote “tallies” raised concerns the information may have helped inform the No campaign’s decision to issue the “vow” of more powers for Scotland from the three main party leaders.

Police Scotland has confirmed that they have now completed their investigation which was launched after the Crown Office instructed that there should be a formal probe following the complaints. The Herald revealed that police twice spoke to Scottish Conservative leader Ruth Davidson as a potential witness over comments she made that the “tallies” were being taken in the weeks before the referendum ballot closed at 10pm on September 18 last year.

It is understood no arrests have yet been made and there are no outstanding warrants. A Police Scotland spokesman said: “Police Scotland has completed enquiries and the matter now rests with the Crown Office and Procurator Fiscal Service.” A Crown Office spokesman added: “The Crown Office has received information regarding the investigation carried out by Police Scotland and will consider if further action is necessary.”

Political agents and campaigners are allowed to oversee the postal vote opening sessions, where checks are made to verify the signatures and dates of birth on postal voting statements against computerised records.

However, Elections Scotland instructions on postal votes in advance of the referendum stated that it is “an offence for anyone attending the opening of postal votes to attempt to ascertain how any vote has been cast or to communicate any such information obtained”.

Failure to observe the secrecy requirement is a criminal offence punishable by up to 12 months in prison and/or to a fine of up to £5,000. Guidance provided to electoral administrators and returning officers for the General Election, as a result of the experience of the referendum, were warned to keep the postal ballot secret and told that voting tallies by political agents is illegal.

Mary Pitcaithly, convener of the Electoral Management Board for Scotland recommended to returning officers in Scotland that they take particular care in making sure the law was complied with during the General Election and that the secrecy requirement was explained to all those attending postal vote openings.

The moves which the EMB said “draw on lessons learned from the Scottish independence referendum” include asking that ballot papers are handled face down so that no mark on the front of the paper is able to be seen by observers. The postal vote, made up between 20% and 50% of the counted votes. Around 800,000 people, or 19% of participants, voted by post in the referendum.

The Electoral Commission has also advised all electoral administrators that the law prohibits tallying at postal vote opening sessions.

The advice states that under the Section 66(4)(d) of the Representation of the People Act 1983 it is “not permissible to attempt to ascertain the candidate for whom any vote is given in any particular ballot paper or communicate that information.

“This provision therefore prevents those present at the postal vote opening from attempting to ascertain the way individual ballot papers are marked.” Police have refused over the year of the investigation to comment on what progress they have made Some complainers raised concern that no police action had been taken in advance of the General Election. Video footage of Ms Davidson talking about the ballot viewing was forwarded to both the police and the Electoral Commission.

In televised coverage she says: “Postal votes are going to be enormously important in this campaign; about 18 per cent of the vote is going to come out of postal ballots and we have had people at every sample opening, around the country, over the last few weeks, while that’s been coming in. And we’ve been incredibly encouraged by the results.”

Later, referring to postal ballots, she said: “Different local authorities have had openings around the country”, adding, “there’s people in the room that have been sampling those ballot boxes that have been opened and have been taking tallies and the reports have been very positive for us”.

A legal challenge to the election of Liberal Democrat MP Alistair Carmichael will begin today over a leaked memo which wrongly suggested Scotland’s First Minister Nicola Sturgeon wanted David Cameron to win May’s General Election.

The former Scottish Secretary came in for intense criticism after admitting responsibility for the leak during an inquiry into the release of the memo, despite originally claiming he knew nothing about it.

Today’s hearing is the result of a petition lodged by a number of Carmichael’s Orkney and Shetland constituents, who are bidding to oust him.

The challenge – funded via a crowdfunding appeal – was brought under Section 106 of the Representation of the People Act 1983, which makes it a criminal offence to release a “false statement” about the character and conduct of an election candidate.

The Election Court will sit for two days in Edinburgh. Full coverage will be aired live on the STV Glasgow and STV Edinburgh channels and online, in a television first for a court hearing in Scotland.
