Could a clean sweep in Scottish 2016 Elections trigger UDI?

Now before anyone gets carried away, I have been reading up on old laws and new laws. I have been told a few times now that should Scotland clear the decks in next years Scottish Elections in a level similar to May 7th this year, with a strong mandate for an SNP referendum, it could actually trigger UDI being enacted by the Scottish Government. I am told it is not as clean cut as this but should we all forget new and old Tory and Red Tory lies and vote SNP there is a law that could trigger Scotland Unilateral Declaration of Independence. I work with several Yes movement people, they find the facts, pass them to me and others, we research and if it seems plausible, we blog it. This is not cast in stone but not to be sniffed at either. We could be free within a year Scotland. We just need to finish the Job. The Europe question is another where London leaving without Wales and Scotland agreement could also trigger an old law, a law I am trying to source. For now this is all I have. Unilateral Declaration of Independence (UDI) is a formal process leading to the establishment of a new state by a subnational entity which declares itself independent and sovereign without a formal agreement with the national state from which it is seceding.

The term was first used when Rhodesia declared independence in 1965 from the United Kingdom (UK) without an agreement with the UK.

The method of UDI is considered controversial in international law.

The International Court of Justice, in a 2010 advisory opinion, declared that unilateral declarations of independence were not illegal under international law.

Scotland’s 700 years old Declaration of Arbroath bares as much relevance in Our Life today as the 300 years old Act of Union does for England today.

The Arbroath Declaration supersedes the Act of Union. In fact, the Act of Union is illegal as it now exists.

The Act of Union, as a Trade Agreement, which it is, is perfectly acceptable.

But our Constitutional Rights as Sovereign Scots were never sighed away.

As soon as the political maneuvering had placed England as the dominate, ruling force, the Act of Union was rendered illegal.

Alistair Carmichael will face questions over why he denied his involvement in leaking a memo intended to damage Nicola Sturgeon. 

The Liberal Democrat MP Alistair Carmichael faces the prospect of giving evidence in court about why he lied about his involvement in leaking a memo intended to damage Nicola Sturgeon after a crowdfunded legal challenge to the Orkney and Shetland MP’s re-election in May passed its first hurdle. Judges in the election court, which is sitting for only the third time in 50 years, ruled on Tuesday that the petitioners passed the first test of whether Carmichael’s lie amounted to illegal practice under the Representation of the People Act 1983. A group of constituents raised £88,000 through crowdfunding to challenge Carmichael’s re-election because voters were unaware of his involvement in leaking the memo at the time of the election, due to his initial denial. The day after the leak, Carmichael told Channel 4 News that the first he became aware of what had happened was when a journalist informed him of it.

He subsequently admitted, following a Cabinet Office inquiry that concluded in May after the election, that he had authorised his special adviser to release the memo about a private conversation in which Scotland’s first minister purportedly told a French diplomat she wanted David Cameron to remain the UK prime minister. Sturgeon and the diplomat have both made clear that the memo was inaccurate. Lady Paton and Lord Matthews ruled that “a false statement by a candidate about his own personal character or conduct made before or during an election for the purpose of affecting his return at the election has the effect of engaging section 106” of the Representation of the People Act 1983.

The judges then stated that they wish to hear evidence in relation to two remaining issues – the distinction between a personal and political lie for the purposes of the act, and whether that lie affected the ultimate outcome of Carmichael’s election – before giving a determination and report to the House of Commons.

The constituents who brought the case welcomed the ruling, saying: “We are delighted that the courts have vindicated our position so far, that the legislation is relevant and there is a case for Mr Carmichael to answer. We look forward to the proof hearing, where questions of his intention and character are considered.” “All the way through this process, we have been very clear that the best outcome is for Mr Carmichael to stand down swiftly so that we can have a byelection as soon as possible.” Cary Welling, another of the petitioners, said the fact that the judges had not immediately thrown out the case, despite the unusual nature of the case and the arcane case law involved, proved that the judges were “going with the spirit of the times”. Welling added: “There is a trend towards accountability and electors holding their politicians to account.”

The election court, which met over two days at the beginning of September, heard highly technical and at times florid legal argument, which included references to Katharine O’Shea and George Washington’s cherry tree. One of the key points of discussion, and arguably of most concern to ordinary electors, centred on the distinction between lies that are political rather than personal in character.

For the petitioners, Jonathan Mitchell QC explained that, according to the act and subsequent case law, there is a broad distinction between political statements that parliament “trusted the good sense of the electorate” to be able to discount, and those relating to a candidate’s personal character or conduct, the truth or otherwise of which the electorate might be “unable to discern” in the middle of an election campaign.

Carmichael’s counsel, Roddy Dunlop QC, argued that his denial was political “from the beginning to the end” while Mitchell contended the opposite, arguing that the fact there is a political background does not disqualify something from being personal. Mitchell told the court: “He puts on to the scales his reputation of personal trustworthiness, and that is purely personal because whether or not the leak is political, nothing in politics called upon him to lie about this.”

Now Carmichael faces the prospect of justifying this lie himself in open court. It is likely that the subsequent hearing will be televised, as the earlier sessions were. While there has been some suggestion that the hearing could move north to the constituency in question, the logistics involved in travel to Orkney and Shetland mean that subsequent sessions are expected to be heard in Edinburgh and live-streamed to Kirkwall and Lerwick.

When I wrote this 12 days ago Scotland – Jeremy Corbyn, Royal Family, Trident, House of Lords, Israel & Video’s <Click) I got a bit of abuse to be fair, not complaining, having an opinion and sharing it will get you all kinds of reactions and opinions so I am used to it. But I will say again I think Jeremy will help more than hinder the Scottish Yes Movement. This is one thing we were told he would backtrack on, but no! He is siding with the SNP/Wales/Greens, this could be HUGE for Trident’s future, how long till Mr Corbyn is called a little Hitler like Nicola Sturgeon was? Jeremy Corbyn has confirmed he will work with the SNP to try and scrap Britain’s nuclear deterrent despite opposition to the move from his own backbenches. The Labour leader reaffirmed his long-standing opposition to Trident and said he would vote with the 56 Nationalists at Westminster on the issue. Mr Corbyn said he would like to see thousands of jobs associated with nuclear defence in Scotland transferred to other forms of high-value engineering, but did not specify what these were.

The SNP welcomed his comments but said the “real test” would be whether he can persuade his party when its debates calls for Trident to be scrapped at its conference, which starts this weekend.

The Tory majority in the Commons, combined with the support of pronuclear Labour MPs, means the Government is highly unlikely to lose a vote on the deterrent’s renewal.

Although a vote in the Commons is not scheduled to take place until next year, earlier this month George Osborne announced £500 million to revamp its home at the Faslane naval base on the Clyde and make it fit for purpose until at least 2067.

DAVID Cameron has “a duty” to answer the serious allegation from Tory donor Lord Ashcroft that he misled the public for months over the peer’s “non-dom” tax exile status, Nicola Sturgeon has insisted. The First Minister’s intervention will add to the pressure on the Prime Minister to make a response to the peer’s claims in his biography of the Conservative leader entitled Call Me Dave.

These also cover allegations of drug-taking and debauchery when Mr Cameron was an Oxford University student, including a lurid initiation ceremony, which was said to have involved him inserting “a private part of his anatomy” into the mouth of a dead pig. Friends of the PM have insisted the claims are “absolute nonsense”.

This is denied by the PM, who insists he only became aware of it a month before the 2010 General Election. Lord Ashcroft, whose millions of pounds in donations kept the Tory Party afloat following its landslide defeat in 1997, was made a peer in March 2000 by the then party leader William Hague and stressed at the time that he would become a UK resident for tax purposes.

However, the ex-party Treasurer did not do so until years later when a change in the law meant he would have had to quit the House of Lords had he not become a UK tax resident.

Ms Sturgeon said of the claim over Lord Ashcroft’s former non-dom tax status: “This is an allegation among many allegations that David Cameron really has to address directly; it’s important that this allegation, that he knew more about Lord Ashcroft’s non-dom status than he had previously said he did, is not lost in the more lurid and humorous allegations that many people are talking about. “This is a serious allegation and the Prime Minister has a duty to respond to it,” she added. Labour’s Jonathan Ashworth, the Shadow Minister Without Portfolio, echoed the point, saying: “The Prime Minister should immediately clarify exactly when he first knew of Lord Ashcroft’s non-domiciled status.”

No 10, however, remained tight-lipped, declining to give any comment on anything contained in the book.

“I am not intending to dignify this book by offering any comment,” declared the PM’s spokeswoman. He (Lord Ashcroft) has set out his reasons for writing it. The Prime Minister is focused on getting on with the job of running the country.” Sources close to Mr Cameron said they “did not recognise” the “pretty low-rent” accusations, which include claims the PM was present at events where drugs were taken and was part of a decadent Oxford University dining society called the Piers Gaveston society; named after the lover of Edward II.

In Call Me Dave, due to be published next month, Lord Ashcroft acknowledges he has a personal “beef” with the PM after his failure to offer him a significant job in his administration following the formation of the Lib-Con Coalition in 2010. He claimed Mr Cameron initially blamed his Liberal Democrat Coalition partners for blocking his appointment, before offering him a junior role at the Foreign Office, which the peer described as “declinable”, adding: “It would have been better had Cameron offered me nothing at all.”

But Nick Clegg made clear he had not blocked the peer’s appointment as a Minister. “No I don’t recollect that at all,” he declared, confirming, however, that he had blocked the appointment of ex-Tory leader Michael Howard as a European Commissioner.

As the row over the book’s claims took off, Lord Ashcroft made clear they were “not about settling scores”. His co-author, journalist Isabel Oakeshott, also denied the motivation for the book was revenge. “If this was just a revenge job, we could have published it before the election. That would have caused more damage,” said the former Sunday Times journalist, who argued that publishing extracts now would do the least amount of damage to Mr Cameron.

I KNEW IT AND SAID IT! Scottish Independence could renew Labour When Johann Lamont stood down I suggested perhaps she was deep down a yes voter. I also said I believed at the time through speaking to people and research there was a HUGE  yes vote within the Scottish Labour Party, now here is the proof. Inside Labour Scotland there is a HUGE Yes movement and I would say over 50%. Their Leader and Vice Leader stood down soon after the No vote last September and I said in a few blogs it was my belief there was a good amount of Labour MP’s being slapped down.

August 17th I suggested Scottish Independence could renew Labour Maybe I was seeing internal Labour killing each other, maybe I should have blogged it more, I am now looking back a year blogging to see if I can find some more evidence or articles then that become more today, things we just didn’t look at and now we do, like many things I am sharing here. What if all along Labour Scotland actually wanted to say “Stuff you London, we are not doing this” Because when Johann Lamont said “Labour London treat Scottish Labour like a branch office” These words by Johann today are more than they were at the time. Now we see Johann was in-fact a yes voter but having to do what she was being paid to do, same “Paid to do” as the BBC allegedly had to do. We remember also Kevin Bridges saying “Everyone in this BBC building wants to vote yes, we have been told not to mention it” Remember? Kevin Bridges admits to BBC lies, 100% Looking back the words were huge, today they are more, especially with Alex Salmond coming out AT LAST on the record saying “The BBC were bias” Kevin Bridges said it, as did many looking back. Now the story is MORE!

Labour should consider having a free vote in any future independence referendum, according the party’s former Scottish leader Johann Lamont.Ms Lamont was speaking as part of a series of BBC Scotland interviews to mark the anniversary of the referendum.The Labour MSP said it was “self-evident” that some people within the Labour movement had accepted that Scotland could be independent. She said a free vote was a debate the party should have.

In the previous interview in the series, Blair Jenkins, the former chief executive of the Yes campaign, appealed to the new Scottish Labour leader Kezia Dugdale to allow members to be allowed to campaign for independence.

He told last week’s Good Morning Scotland programme he thought there would be “very strong pressure” on the party to do that – even if the official position would be against independence.

Mr Jenkins said he would prefer Labour to back a Yes vote but “as a minimum position” they should allow prominent people in the party to campaign against its policy as they did in the 1979 devolution referendum.

She told Good Morning Scotland: “We know that there were Labour people who supported Yes and we need to understand what that was and have that debate inside the party.
“It’ll be for others to decide whether you then make it a free vote. People clearly exercised their vote in the ballot box anyway.”
She added: “If that’s a debate we should have inside the party, why not? Because what is self-evident is that there were people within the Labour movement more broadly who did accept the argument that Scotland could be an independent country.”

Despite saying the idea of a free vote should be debated, Ms Lamont added any decision over independence was “far bigger” than what was voted on in 1979. Ms Lamont also said that “on balance” she believed Labour was right to join with the Conservatives in the Better Together campaign.
But she said Labour should have had a better resourced and more energetic campaign of its own. In the interview she said she felt “pushed to jump” before she left the role but she refused to point the finger of blame at Ed Miliband or at Margaret Curran, an old friend who was at the time shadow secretary of state for Scotland.

Great news for East Coast Scot’s today this. The ‘Hope over fear tour’ that was sadly denied in Glasgow last month when a Pro-Union group asked the Glasgow Council if they could march also, basically Unionist groups submitted permission to stop Tommy, I would believe these angry people, as many are, did this knowingly, sadly on police advice Tommy was denied a peaceful walk in Glasgow because a group of people who in all fairness would possibly cause trouble and ruin our peace, this is what we ARE and WILL free ourselves from sooner than I think many Scots realize. I do not suggest for 1 second all Union supporters are bad people, I know Unionist voters who would still vote no, but they are amazing people so this tells us that not all no voters are the hatred we have seen too often in Scotland over matters of independence. But before you bash me in the teeth with your keyboard understand the Glasgow Council didn’t allow with reason being “Possibility of trouble or violent clashes” Now I am just saying this, I have never heard 1 pro-independence march/protest/whatever having any trouble caused by the people involved in or who arranged these marches. However do we need reminded what a very small % of people do want to be and show anger on our streets against something many of them do draped in a Union flag hating us as much as Westminster do but with total lack of reason and understanding of the political and human side of our movement here, Scottish people I am talking about, why? The date I did this was September 29th 2014 and I guess I was still angry at what all yes voters at the time thoughts had happened, that we may had been cheated, images and video’s covered the internet of alleged irregularities as well as the guy with the bags of votes, I wrote that blog maybe not angry but not taking the no vote very well, as at the time with everyone I knew, nobody knew many no voters, we were in shock. So here we go again, Tommy is gearing up for more of the same as we approach the vital Scottish Elections in 2016 with the potential to almost loosen the shackles from Westminster. We have a real chance to wipe the floor in more regional places like we did winning 56 from 59 seats this last May 7th, the swings were huge and only a minor miracle at this stage of play will keep Labour in any kind of real power in Scotland, we can really paint the Country Yellow and keep it this way with a surefire Referendum accompanying a good political SNP win next year. Please never let us forget nor lose reason of focus when we ask “Why did the Glasgow Council call off the March with Tommy and Yes support” of why it was not given permission. Know it’s reasons!

Plans for a pro-independence rally through Edinburgh to mark the first anniversary of the referendum are expected to be given the go-ahead by the city council later this week. Tomorrow councillors are expected to approve the Yes 2 Scotland event, which will see a march along King’s Stables Road, the Grassmarket and to the Scottish Parliament.

If granted permission by Edinburgh City Council’s licensing sub-committee, the event will take place a week tomorrow, 18 September, exactly one year after Scotland voted by 55 per cent to 45 per cent to stay within the United Kingdom.

The Edinburgh rally looks likely to be given the green light, despite a pro-independence event organised by supporters of former MSP Tommy Sheridan in Glasgow being banned amid police fears of clashes and disorder. Glasgow City Council has taken the decision to deny Hope Over Fear permission for a rally in the city’s George Square after a pro-Union group made a rival bid. The authority said it had received advice from Police Scotland that two events clashing could spark public order issues.

Last month the council said it had declined both applications. The absence of a rival event in Edinburgh means that the march through the capital is likely to get the green light. A report to the licensing sub-committee states: “The council has limited powers available regarding the control of such events. These powers should only be exercised to prevent public disorder, risk to public safety, damage to property, or excessive disruption to the life of the community.”

A legal challenge to the election of Liberal Democrat MP Alistair Carmichael will begin today over a leaked memo which wrongly suggested Scotland’s First Minister Nicola Sturgeon wanted David Cameron to win May’s General Election.

The former Scottish Secretary came in for intense criticism after admitting responsibility for the leak during an inquiry into the release of the memo, despite originally claiming he knew nothing about it.

Today’s hearing is the result of a petition lodged by a number of Carmichael’s Orkney and Shetland constituents, who are bidding to oust him.

The challenge – funded via a crowdfunding appeal – was brought under Section 106 of the Representation of the People Act 1983, which makes it a criminal offence to release a “false statement” about the character and conduct of an election candidate.

The Election Court will sit for two days in Edinburgh. Full coverage will be aired live on the STV Glasgow and STV Edinburgh channels and online, in a television first for a court hearing in Scotland.
